This is the privacy policy ("Privacy Policy") of Dr. Leonard's, a division of Midwest Catalog Brands, LLC and the DrLeonards.com website (referred to below as the "Site"). We describe in this Privacy Policy the types of information we gather about you, how we use and share that information, and how you can control how you're marketed to. Throughout this policy, "Dr. Leonard's" means Dr. Leonard's, a division of Midwest Catalog Brands, LLC, and "we", "our", and "us" means "Our Family of Companies". "Our Family of Companies" is also sometimes referred to herein as "Affiliates". Please click here to see a current listing of Our Family of Companies.
More details about information we collect and disclose is presented in our Financial Privacy Notice relating to financial privacy, which is required by the federal Gramm-Leach-Bliley Act for companies that grant credit. 1. Information We Collect
We collect information about you in three ways: first, we collect certain information from you, such as when you submit it to us or the Site or otherwise interact with us; second, we collect information automatically, or passively, when you interact with the Site; and third, we sometimes receive information from other parties.
a. Information We Collect From You
We collect certain information from you, including when you make purchases or require delivery, when you establish an account with us, register to use certain features of our Site, communicate with customer service, or you otherwise interact with us, whether online or offline. This information includes, but is not limited to, the following:
- In order to make purchases, to access certain information, features or services at the Site or offerings of Dr. Leonard's, you may be required to provide certain information, including your name, address, email address, telephone number, and similar personal or contact information.
- We collect your credit card information and other payment details (or work with a payment service processor or vendor to do so), when required to complete a transaction.
- If you use our credit plan or submit a credit application, we may collect other information from and about you such as financial information.
- We collect any information you provide in comments or suggestions to us and when interacting with our customer service or other departments, such as recordings of those communications and your contact details.
- We collect information you provide via surveys, promotions, sweepstakes and contests, or other outreach programs.
- If you sign up for our wish list service, you provide us with information concerning your gift selections.
b. Information We Collect Passively
We also collect information by automated means such as cookies, web beacons and similar technologies when you visit our Site, interact with our ads on other websites, or open our emails. Cookies are small files that contain a short line of text that are stored on your browser or device and perform a variety of functions. A web beacon, also known as a web pixel tag, links web pages to web servers and their cookies, and may be used to transmit information collected through cookies back to a web server.
We use technologies such as cookies and web beacons on our Site to for several purposes, including to maintain the Site and enable certain features and functionalities, to better understand how you use our Site, and to serve you more relevant ads (see below). For example, cookies help us provide the Site by allowing us to know what item(s) youāve browsed or have placed in your shopping cart even if you decide to leave the Site and return at a later time to finish shopping. If you have consented to receive our SMS messages by clicking the opt-in checkbox and providing a mobile number on our website for the code 59186, we may send you shopping cart/browsing reminders to the mobile number used when signing up. Cookies and web beacons can also help us understand if you open our emails.
The information we collect and maintain through technologies such as cookies and web beacons includes, without limitation, your IP address, browser type and other browser characteristics, operating system, referring URLs, information on actions taken on our Site (such as what pages you view, and what links you click on), cookie and device IDs, and dates and times of Site visits.
We work with certain third-party advertising platforms who place cookies on our Site and in online ads (or emails), in order to track Site visitors and help us tailor and analyze ad performance. These advertising platforms may collect and use similar information (e.g., IP address, browser type, etc.) on other websites. For instance, if you tend to view recipe websites, these providers might serve an ad for us or another company that sells gourmet food products. You may be able to configure your browser or device to disable cookies or notify you when they are being set. Some cookies are "strictly necessary" or "essential" because without them, the Site and our services cannot function; you cannot disable these cookies. Note that if you block all cookies, our Site and many other sites will likely not function as intended, and key functionality of this and other websites may be lost. Cookie settings are specific to a browser or device, so if you access the Site or otherwise engage with us through a different browser or device, if you clear all cookies on your browser, or if you use a browser that automatically clears cookies, you may need to repeat your preferences.
c. Information We Receive From Other Parties.
- We collect information from affiliates within Our Family of Companies. Certain of those affiliated companies may use the information in a service provider capacity, e.g., billing, collections, credit analysis, other analytics or data marketing and sales, whereas others (i.e., any listed in the footer of a web page on this Site) may use the information for their own purposes, such as for marketing or analytics. (The brands and companies listed in our website footer are among those who will receive such information).
- Similarly, we sometimes collect information (such as contact information, or interest data connected to a person's contact information) from third parties with whom we have marketing, advertising or service relationships, such as data compilers or consumer data resellers, survey companies or affiliate marketers. Sometimes, we use these companies to enhance Information we already have (such as regarding your demographics or likely interests).
- We also may collect information or receive from consumer reporting agencies, as appropriate and/or required under law.
2. How We Use The Information We Collect
We use the information we collect for the below purposes:
- To operate and support our products and services;
- To process credit card transactions and, as permitted by law, to make decisions about the extension of credit using data from consumer reporting agencies;
- To fulfill orders and ship products;
- To communicate with you, including customer service and account-related communications;
- To advertise and market our products and services, including by direct mail, email, display media, and other channels such as "addressable" television. When we market through display media, we use cookies and other technologies as described in Section 1;
- To evaluate and improve the quality of our products and services;
- To personalize Site content, for instance, to attempt to provide more relevant content, based on prior purchases or other information regarding your likely interests;
- To analyze how you use our Site or engage with our advertising (and to measure advertising performance);
- To protect and secure the Site and our operations;
- As otherwise necessary or appropriate to provide requested services or products to customers or Site users;
- To comply with legal and regulatory obligations and enforce our legal rights; and
- For any other lawful purpose, with your consent where legally required.
We may combine information that we collect from one source with any other information we collect for any of the purposes above. We may appropriately aggregate and de-identify information, which we may use and disclose for any purpose to any party, in our discretion.
3. How We Disclose Information
We may disclose the information we collect to the following types of parties and in the following situations, for the purposes listed above:
- Affiliates. We disclose certain information to members of Our Family of Companies.
- Vendors. We disclose certain information to entities that provide us with services pertaining to Site maintenance, billing, collection, credit extension, credit card processing, account processing, customer and technical support, web and server hosting, shipping, and order fulfillment. We also disclose certain information to analytics, marketing, and advertising vendors, including vendors that assist with email, display and direct mail marketing, data enhancement, email delivery, printing, data and marketing analytics, and campaign creation and analytics.
- Marketers. We may disclose certain Information, including our mailing lists, to third parties for these parties' advertising and marketing purposes. These parties include "co-marketers" that advertise their products alongside ours; unaffiliated marketing organizations who we have banded with cooperatively in order to mutually enhance our advertising and marketing efforts; and other unaffiliated third parties such as ad platforms and companies.
- Disclosure for Legal Process. We may disclose information when we believe in good faith that disclosure is necessary to (i) protect our rights and/or to comply with applicable law or a judicial or administrative proceeding, court or governmental order, or legal process served on us; (ii) detect and prevent fraud or other illegal activity; (iii) prevent imminent bodily harm; or (iv) prevent harm to Dr. Leonard's, Our Family of Companies, the Site, our customers, or any other person or entity. This may include disclosing information to other companies, lawyers, courts, or other government entities.
- Corporate Asset Transactions. We may sell, buy, merge or partner with other companies or businesses, or sell some or all of our assets. In such transactions, any information we hold may be among the transferred assets and may be disclosed during due diligence leading up to any transfer or as part of such transfer.
- Consent. We may disclose information in any other circumstances where we have your consent.
4. Interest-Based Advertising and Your Marketing and Advertising Choices
We may engage in various types of interest-based and cross-channel and cross-device marketing, as follows:
- Interest Based Advertising. We work with third-party advertising platforms to place advertising, which may be through display, email, direct mail, or other methods. These third-party platforms use technologies like cookies and web pixels that we describe in Section 1 for various purposes, including to (i) inform, optimize, and serve ads based on past visits to our Site and other sites (or other information about you), (ii) serve ads on other sites, (iii) report how our advertising performs (for instance, whether advertising impressions may be related to visits to our Site other transactions or activities), or (iv) analyze website visits or ad campaigns in other ways. This type of advertising -- i.e., using behaviors over time and across sites to serve more relevant ads -- is often called "interest-based advertising."
- Use of Email "Hashes" for Advertising. Similarly, when you visit our Site or open our emails either we or the ad platforms we work with may place cookies (or similar technologies) have been associated with personal, demographic or other data that is linked to or derived from data you voluntarily have submitted to us (e.g., your email address) but has been altered through mathematical "hashing," and that we may share with a service provider to trigger or suppress an ad. Through these and other identifiers (which are de-identified but may have been derived from your contact information), service providers we work with may target, measure, or analyze advertising to you on a variety of other platforms (for our products or other products), such as through direct mail, email, or "connected" television channels, as well as social media platforms.
- Cross-Channel and Cross-Device Marketing: In order to provide more relevant ads and marketing, including discounts, we may engage in "cross-channel" and "cross-device" marketing, including with assistance from third-party providers. This means that information that we or our providers collect through one device or method of marketing may be associated with other information to allow us (or in some cases, an affiliate of ours) to market to you through another device or marketing method. For instance, if you visit or purchase products through our Site, we may use information such as your email or IP address to send offers to a mobile device that we think you are also using. Or, if you visit or log-in to our Site, we may associate Information we collect with other personal or de-identified information in order to send you a "direct mail" flyer or coupon -- for example, to provide a discount to you for a product that you've expressed interest in, or a similar type of product.
Opting Out of Interest-Based Advertising. If you are interested in more information about interest-based advertising and how you can generally control cookies from being put on your browser or device to deliver interest-based advertising, you may visit the Network Advertising Initiative's Consumer Opt-Out Page and/or the Digital Advertising Alliance's Consumer Opt-Out Page. On those sites, you may opt out of receiving interest-based advertising from companies that participate in those opt-outs. If you opt out in this way, you may still see ads for us and our products and services, but these ads may not be tailored to your interests. The above opt-outs are cookie-based, so if you delete your cookies (or change your browser), you'll need to opt out again. We do not control any of the above opt-out links and are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms.
Mobile Advertising Choices. We may sometimes work with vendors who serve ads through mobile apps, and these may be "interest-based" as well. Each operating system (e.g., iOS and Android) provides its own instructions on how to prevent the delivery of interest-based ads. Your Choices Regarding Promotional Catalogs. If you no longer wish to receive our promotional catalogs, you may call us at 866-426-6252 to request for those mailings to be discontinued. As a member of the Direct Marketing Association, we comply with its requirements for consumer choice, including its Commitment to Consumer Choice and DMA choice programs, and honor opt-outs from marketing communications through those programs. You can find more information about the DMA and its Commitment to Consumer Choice at: https://www.dmachoice.org. Please understand that it may take several weeks for requested changes through these procedures to take effect and for such mailings to be discontinued.
Email Marketing. You may opt out of our marketing and promotional emails by clicking the "unsubscribe" link at the bottom of such emails. It may take up to 10 business days for this to take effect. You may also adjust your subscription settings via your account on the Site. If you unsubscribe from marketing and promotional emails, you may continue to receive non-promotional and non-marketing emails from us, such as emails regarding your orders, your account, updates to our terms and policies, and other similar information.
5. Accessing, Correcting, and Amending Your Personal Information
If you have an account with us, you may be able to adjust certain information through your account (accessible via the "Your Account" link at the top of the DrLeonards.com home page). Within your account, you may view and change certain information that we have collected from you. If you believe that the information that we have collected from (or about) you is inaccurate and you cannot access such information through your account, you can call us at 866-426-6252 or write to us at Credit Dept., 1112 7th Avenue, Monroe, WI 53566.

6. Retention
We retain information to enable your continued use of the Site and our products and services, for as long as necessary in order to fulfill the relevant purposes described in this Privacy Policy, or for other essential purposes such as complying with our legal obligations, resolving disputes and enforcing our agreements. Because these needs can vary for different types of information in the context of different purposes and services, retention periods may vary.
7. Security
We maintain safeguards designed to protect the confidentiality of your information. However, processing and transmitting information online cannot be made absolutely secure. Consequently, we shall not be liable for unauthorized disclosure of your information due to no fault of Dr. Leonard's including, but not limited to, errors in transmission and unauthorized acts of the staff of Dr. Leonard's or Our Family of Companies and/or Third Parties. You are responsible for all activity that takes place under your account, including unauthorized activity.
8. Children's Privacy
Dr. Leonard's does not knowingly collect any "personal information" (as defined in the Children's Online Privacy Protection Act) from children under the age of thirteen. We also do not knowingly post content (e.g., reviews, comments, or blog posts) provided by children under the age of 13. 9. User Content
If you post, upload, or comment on the Site ā for example, if you participate in a discussion forum or post messages to a bulletin board on the Site, such as product reviews ā any information you provide in this way ("User Content") may be broadly available to other people who have access to the Site. Any opinion posted by individuals in a forum, bulletin board, or otherwise is his or her own and should not be considered as reflecting the opinion of Dr. Leonard's or Our Family of Companies. Dr. Leonard's reserves the right, but has no obligation, to moderate any User Content on the Site and to remove any User Content that is offensive, profane or otherwise inappropriate or objectionable in the sole discretion of Dr. Leonard's. We are not liable for any User Content.
10. Links to Other Sites; Third Party Technology Interfaces; and Applications
While visiting the Site you may have the opportunity to link to, interact with, or receive content from websites operated by our business partners or other third parties. Those sites may have the look and feel of being on our site, but are not our Site, not under our control, and therefore not subject to this Privacy Policy. If you provide information to a third party, including via a third party site, you are subject to the third party's privacy policy and information practices. We are not responsible for the privacy policies and practices of any third parties. Therefore, we strongly recommend that you check the policies of third party sites you visit.
If you are utilizing a third party application when you visit the Site, such third party application may, as part of its functionality, provide information about your visit to us or to others, subject to the terms and conditions of use and/or privacy policy of such application. Accordingly, you are encouraged to familiarize yourself with the ways in which such applications may collect and disclose your information.
11. Updates to our Privacy Policy
We reserve the right to amend this Privacy Policy from time to time and to apply any changes to information previously collected as permitted by law. Changes will be posted on the Site and are effective upon posting. Please check back periodically to view this Privacy Policy as you continue to use our Site.
12. Nevada Residents
If you are a Nevada resident who has purchased or leased goods or services from us, you may submit a request to opt out of the sale of your personally identifiable information under Nevada law through the methods described in Section 3, under the heading 'Use by Marketers and Co-Marketers.' Please note we may take reasonable steps to verify your identity and the authenticity of the request.

Multi-State Privacy Addendum: Privacy Notice for Residents of California and Other U.S. States
This section applies solely to residents of California and certain U.S. states, including Colorado, Virginia, Utah, and Connecticut ("Applicable States"), with consumer privacy laws (collectively, to the extent applicable to us and when effective, "Applicable Laws"). This section applies to the extent that such laws have entered into effect and apply to us. This section supplements the information in the Privacy Policy above. In this section, "you," "your," and "yours" refer to residents of Applicable States.
You may have certain rights regarding your "personal information," as defined in the California Consumer Privacy Act (as amended, "CCPA"), or their "personal data," as defined in other Applicable States' privacy laws (collectively, "personal information"). The particular scope and nature of these rights vary in each state, so we have sought to explain these rights in the most transparent and uniform terms. You may have the right to request that we:

Access and Deletion of Your Information. You may exercise your access and deletion rights by submitting a request to Access or Correct Your Information, Delete Your Information, or by contacting us at 866-426-6252. Access requests include requests to confirm processing and receive certain information about our activities as specified above ā please specify the right you want to exercise in the webform. You may opt out of the "sale" or "sharing" of your information as provided above.
For security purposes and as required under Applicable Laws, we may verify your identity ā for example, by requesting certain information from you -- when you make certain requests. Once we have verified your identity, we will respond to your request as appropriate. If we are unable to complete your requests fully for any of the reasons above, we will provide you additional information about the reasons that we could not comply with your request.
Opt-Out of Sale, Sharing or Targeted Advertising. You also have the right to opt out of the "sale" of your personal information or the "sharing" of your information for cross-contextual advertising ("sharing" also refers to the use of personal information for purposes of "targeted advertising," as defined in Applicable Laws). Applicable Laws may broadly define "sale" in a way that may include allowing third parties, such as advertising networks to use information such as cookies, IP address, device identifiers or other hashed identifiers and browsing activities to target ads to youā for instance, to retarget a company's website visitors with ads about that company's services, which (unless other forms of information "selling") we may sometimes take part in. Minors' Data. We do not knowingly "sell" or "share" personal information from minors under 16 years of age.
Non-discrimination. You also have the right not to be discriminated against (as defined in Applicable Laws) for exercising these rights. You may also have the right to receive a notice of the "financial incentives" we may provide you, if any. These rights are subject to limitations and exceptions under Applicable Laws. For example, we may need to retain certain information to comply with legal obligations, and we many deny your request to delete such information. Additionally, we need certain types of information so that we can provide our services to you, and if you ask us to delete it, you may no longer be able to access or use our services.
Use of Authorized Agents. You may also designate an agent to make requests to exercise your rights on your behalf. We may take steps both to verify your or your authorized agent's identity and to verify that your agent has been authorized to make a request on your behalf through providing us with a signed written authorization or a legally sufficient copy of a power of attorney.

- The CCPA allows you to limit the use or disclosure of your "sensitive personal information" (as defined in the CCPA) if your "sensitive personal information" is used for certain purposes. Please note that we do not use or disclose "sensitive personal information" other than for purposes for which you cannot exercise the right to limit under the CCPA.
Additional Information for Residents of Colorado, Virginia, and certain other Applicable States: Applicable Laws may permit you to appeal any denials of your rights requests; to do so, contact us at [EMAIL] and describe in detail why you believe the denial was in error. b. Personal information we collect, use, disclose, and "sell" or "share"
Throughout the Privacy Policy above, we discuss in detail the specific pieces of personal information and sensitive personal information we collect, the sources of that information, and how we disclose it. Under the CCPA, we also have to provide you with the "categories" of personal information and sensitive personal information we collect and disclose for "business or commercial purposes" (as those terms are defined by the CCPA). Colorado's law requires similar disclosures.
